I know one of the reasons why so many vacancies have gone unfilled under President Obama is because Congress would not technically go on recess, thereby not allowing Obama to even make a recess appointment.
And once, when Obama did try to fill some anyways, saying it effectively was a recess... and the Supreme Court ruled that was unconstitutional:
