We last declared war on June 5, 1942 against Bulgaria, Hungary, and Romania. Aren't you glad that we're such a peaceful nation?

I think it is correct that Congress do this, however, I support a constitutional amendment stating that Congress may only use the draft when it has explicitly declared war. It shouldn't get to use the draft for what it effectively calls military interventions and the like.

The most common argument cites the power to "raise and support Armies," in conjunction, if necessary, with the necessary and proper clause.

Um, no. I was just pointing out that the fed can't just do anything it wants to 'raise and support armies.'

Well the war he points out is when congress "declared" war.  The current Iraq war, had congressional approval, but not a formal declaration, it is therefore unconstitutional, since the constitution gives congress the right to declare war
