Well, you say "shot" and not "shot and murdered" so there isn't enough information to go on.  If you meant "shot and murdered" he would be tried and convicted if there is enough evidence to do so. 

Yes, some rich people have and do get out of serious trouble from time to time, very few of them shot someone in the middle of a busy NYC street.  There are many rich people in prison right now that thought their money would keep them out of trouble.
