If the Chinese national had a green card at the time of the donation: McAuliffe is in the clear.
No green card: McAuliffe is in trouble.
Also depends on the circumstances of the green card. McAuliffe and Hillary Clinton's brother had a racket selling EB-5 Investor Visas a while back through some sham car company. An inspector general for the Feds agreed that there was at least one seemingly improper instance of the State Department intervening in one of these visa cases on behalf of McAuliffe-Rodham.
