Of course my preferred solution only works in common law countries and I'm not sure how to resolve that. In the case of Canada I'm not sure how it would apply or fail to apply to Quebec.
Assisted suicide was banned under Criminal Code. Quebec uses the federal common law for crimes, for the record. There is no such things as malpractice in Quebec, you sue the hospital and/or make a complain to the Doctor's College in hopes they will ban him from practice. The "let's sue doctors for malpractice" is a VERY american thing.
