As for me, I voted "No, but I support affirmative consent laws in another form."

Indeed, while affirmative consent laws might very well be good laws in theory, the way that affirmative consent laws are currently written and implemented makes me hesitant to support these laws. Why? Well, this FIRE response to Ezra Klein's pro-affirmative consent article helps explain why exactly I have and hold this position:

Yeah. Of course it's easy to think rape culture is not a serious problem that justifies making serious changes to our legal system to combat it when your chances of actually getting raped are next to nil.

As for these laws, they're a small steps in the right direction, but don't address the core of the problem IMO.

     No. Affirmative consent is a rather incoherent attempt to do something about something that is almost as ignorant of the principles of criminal justice as it is of human interaction. I am open to ideas on something to do, but I don't see affirmative consent laws being the answer.

I think his point is that, under this proposed legal definition, he's been "raped" many times, which would, as he implies, be farcical.

Personally, I think there are better legal and institutional changes that we can make to help rape victims and make them feel like judges and the officers of the law are on their side, and that we should continue to bang the drum of "REPORT IMMEDIATELY" until it's a reflex like "stop, drop, and roll."

     This is a good idea, for example. The police are criticized for not helping victims, yet some fairly prominent rape accusations are never reported to the police. I would generalize it and say that if you have been the victim of any crime, you should report it right away. The longer you wait, the harder it will be to build a case against the criminal and the more likely that they will walk.

Yeah, but a better solution to that is not an illogical change to the law, but to crack down on the disbelief, outright shaming, and other forms of institutional sexism.
