As long as he is not violating any law with his posts, no. This is a country of free speech and not censorship. The only justification for a ban is behavior, that is found unlawful by courts.

No, but I don't think they'll have to. If it wins his account will (hopefully?) be regulated by his staff, so it won't be his anymore. If he loses I suspect the sudden loss of attention and massive drop in followers that's sure to come will shame him into quitting it on his own volition.

Twitter is a private institution and they can ban anyone. That said, it is a unique form of communication that should at least afford some protections of free speech to its users whether that is constitutional or private policy. I think we should wait and see. If he succesfully solicits or incites a felony in the coming days and weeks, he should be perman&. End of story.

Should Trump win the election, the Secret Service is going to have quite a bit to say about Trump's twitter habits.  They took Obama's Blackberry away, and they have a responsibility to assure that the President doesn't leak information that could jeopardize himself or the integrity of government.

Of course, Trump could just fire them all and hire his own goons that will let him do whatever he wants.

Now, if Trump loses, he can tweet away to his heart's content Smiley.
