UN Ambassador has often arbitrarily been made a Cabinet or non-Cabinet position by whoever the president is. So Frank could still do it if he declared the position was non-Cabinet.

That would have predated the law. And she'd have been appointed, by the Secretary-General, in any case, meaning it wouldn't have applied.
