current congress leaves december 16th; new congress arrives january 3rd. can obama do anything of substance in the intervening two and a half weeks? what happens if he swaps out merrick garland?

No, serious: Actually not that much as a lame-duck president. He could chose the nuclear option with Garland, but as soon as congress reassembles, the nomination has to be confirmed. And, as we know, that won’t happen. Maybe a few executive orders, for example Gitmo, but they can and would likely be rescinded on January 20. I think what he should do as a last business is open the JFK papers, before they have to be opened in 2017 under a 1992 law.
