I hope for adoption of an amendment that rewrites Section 1 of the 14th Amendment, second sentence, to make its meaning narrower and clearer.
This sentence needs to be repealed: “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
It needs to be replaced with rules that are much more detailed and specific. The rules of what states cannot do should be as specific as the rules we see in the Bill of Rights -- the first eight amendments. States should have clear guidelines about what they cannot do, and the federal judiciary should have far less discretion in choosing which state/local laws to strike down.
In Jan. 2014 I drafted a proposal to do this. I have mailed copies of it to members of the House Judiciary Committee and Senate Judiciary Committee, and I will continue doing so.
I support having an Article V convention too, if Congress won't propose it. See
