The controversial First Amendment Defense Act (FADA) could be re-introduced this year, according to the bill’s Republican co-sponsors Senator Mike Lee, R-Utah, and Senator Ted Cruz, R-Texas, who say they still fully support the once-failed legislation. FADA, which protects people or businesses who refuse services to LGBTQ individuals, was introduced in 2015, but never made it past the first congressional hearing.

The bill’s text says the refusal of service can be based on two beliefs: that marriage “is or should be recognized as the union of one man and one woman” or “sexual relations are properly reserved to such a marriage.”

FADA allows individuals and businesses to sue the federal government for interfering with a refusal of service. It would also mandate the U.S. Attorney General to defend those businesses.

The bill already has the support of President-elect Donald Trump. In a statement on his campaign website, Trump said “If I am elected president and Congress passes the First Amendment Defense Act, I will sign it to protect the deeply held religious beliefs of Catholics and the beliefs of Americans of all faiths.”

Are they serious with that text? Jesus, that's not even viewpoint neutral. It only lets businesses discriminate based on their anti-gay marriage beliefs. Conservatives won't even be able to defend that bill with the old, "Yeah, and a gay business owner should be able to refuse to make a cake for a fundamentalist Christian too" shtick. (Also it'd probably be struck down by even the most hackish conservative federal judge).

Don't try to tongue lash him into agreeing with you.  Unfortunately with cases like this, the hard way is the only way that will convince someone.  And judging from what I see on Atlas... it would only take one incident to change Smilo's mind... but you'll never convince him otherwise.

To paraphrase Garrison Keillor:

We're all Republicans until something bad happens to us.  Then we become Democrats.

And Smilo:  I'm talking about your political positions and ideals in general... not specifically the cake-baking issue.  You kind of revolve chaotically in a way that makes your positions very hard to actually understand.

See, I'm sympathetic to this viewpoint, but the thing is that anti-discrimination already exist. As long as things like race and gender are part of those laws, it makes no sense to exclude sexuality from those same laws.

I think the free market should take care of any perceived or real discrimination, so I oppose all non-discrimination legislation on principle, even if I would never support true discrimination (and it's not discrimination for a Christian bakery to not bake a cake for a gay wedding).
