What would happen if someone who is very slightly too young (by like a few days or weeks) is elected to a body, say the Missouri House of Representatives for example. The age limit is 24 years for Representatives here in Missouri. Say someone was born on January 11, 1993 and was elected to the MO House. They would normally be sworn in tomorrow, the first Wednesday after the first Monday in January. However, they are still one week from their 24th birthday. Would they be allowed to leave their seat vacant for that week and be sworn in on January 11th?

When Rush Holt was elected to US Senate at the tender age of 29, he has to wait until June to be sworn in. So... wait a week, likely.

IIRC, the same problem kept Biden's term from starting for a short while.
He turned 30 on November 20, 1972, so although he was 29 when elected he was 30 by January 3.

IIRC, the same problem kept Biden's term from starting for a short while.

The congressional bioguide lists his term as beginning at the regular date, that is January 3, 1973. I think it was just a formality of being sworn-in that was delayed for two days.
