~1.3% of driving fatalities are cell phone related

It's still ok to talk on a phone hands free, but lack of hands isn't what 'causes distracted driving, it's lack of brain activity devoted to the task of driving.

30000 * 1.3% = 390 deaths via cellphone-in-car. And are we sure that there aren't cases where involvement of a phone was involved but it wasn't reported because there weren't any signs of it? You don't really gain anything by keeping it legal, plus its a pretty minor safety thing like seat-belts, so it doesn't really infringe on peoples rights.

Enforcement is difficult, however; though the mere presence of a law may deter some people.

Texting while driving is a bad idea. Even if you took distracted driving laws off the books, someone who caused an accident because they were using their phone would still get charged with causing an accident and possibly have their insurance canceled. Laws aren't based on percentages, anyway.

Hand it to a passenger.

I saw some speeder drive someone onto the shoulder, something unforgivable unless in an emergency. Basically it had better be a first responder.  I handed the cell phone to my aunt, whom I was taking back from a doctor's appointment, and asked her to deal "9-1-1" to report the incident to the police. I wanted that fellow busted and ticketed. I wanted to see him down the road with a state trooper making his day go bad.

I could not have called the cops at the time.

Mobile phones are banned in Australia whilst driving. You have to use hands-free, otherwise it is a $300 fine.

Distracted drivers looking at a phone screen kill others and themselves.

No question.
