Of course, MODU is correct that the law cannot be changed halfway through the process. States are explicitly forbidden to pass ex post facto laws.

Hawaii was a different case. There was no change in the law halfway through the process simply because there was no law to change. The Hawaiian Legislature, as far as I can tell, did not legislate the December safe harbor deadline, but the Florida Legislature did. That is the crux of the matter.

The deadline doesn't require that the recount end before then. Also, the FL supreme court should have the power to overrule the legislature.
