What a pig. What about the rights of poor people who need legal defense? He is a Rockefeller Republican who uses wedge issues like abortion and gay marriage to trick liberals. He's no better than war criminal Schumer. Just utter trash.

My opinion of him just went down further and I didn't think that was possible - and I'm a new York Democrat

It may play well in the Northeast and the West Coast, but in Middle America? I don't know. However, Gov. Cuomo is still a contender. He must not be taken lightly. Underestimate Cuomo at your own peril.

This is the kind of thing that he'll tout in the primary campaign, but that would be a non-factor in the general election, if he were to actually be nominated.

Same reason why Booker and Gillibrand are voting against all those Trump nominees.  It's the safer thing to do for the Democratic primary, and nobody will care about it in the GE.

Even if he puts it in it won't prevent anything Trump and the Feds do. It would be solely to pander to the NYC base.

Nice. He's still about as progressive as Dewey and about as ethical as Luciano.

Do you not understand how federalism works or??

Anyway, this is great news. The U.S. Constitution already recognizes a right to an abortion with certain restrictions, so the state constitution should as well. Of course the resident misogynist Bernie Bro at the top of the thread opposes this though lol

NY Republicans and Reuben Diaz, it's up to you to stop this.

If Roe v Wade is over-turned it will probably go to state law. In most cases, I believe state law forbids abortion (no idea about NY). I'm rather surprised more states haven't done this.

I support this, but this is obviously a political move by Cuomo and I hope people can see through it.

Do you doubt that Cuomo is sincerely pro-choice?

No; I just think that this is an attempt to win favors with Democrats. However, that's a fairly normal thing for politicians to do so maybe I shouldn't be so hard on Cuomo. Anyway, regardless of the status of Roe v. Wade in 2020 I think this will help him a bit in the primaries and have a net zero impact in the general.

Cuomo is one of the most liberal current politicians on social issues.  Remember that he has said that pro-lifers have "no place" in New York.  He also announced that he is a black, gay, Muslim-Jewish woman:

Abortion was legal in New York before Roe v. Wade.

I always love how the governor who told conservatives like me that we have no place in New York preaches "tolerance" when convenient.  Of course, as is true with many "progressives", to Cuomo, "tolerance" is only for those with which he agrees.

Very appropriate use of quotation marks around the word "progressive", fam. Cuomo is a certified right-wing stooge.

You lost.

Get over it.

I'll keep that in mind when President Trump claims to speak for all Americans and you disagree.

Cuomo right wing?  He raised the minimum wage to $15 an hour, told a good portion of the population they don't belong in the state based on their political beliefs, is currently running ads about the wonders of Obamacare, and thinks it's a good idea to let anyone and everyone into the country.  That's not right wing.  Cuomo is a "progressive".

Anyway, this is great news. The U.S. Constitution already recognizes a right to an abortion with certain restrictions, so the state constitution should as well.

No, the U.S. Constitution is utterly silent about abortion -- silent whether a pregnant woman has a right to it and silent whether a fetus has any rights.

Roe v. Wade was an invention of the Supreme Court, it did not come from the Constitution. As Prof. John Hart Ely said back in 1973, Roe "is not constitutional law, and gives almost no sense of an obligation to try to be." (Source: http://www.nytimes.com/2003/10/27/us/john-hart-ely-a-constitutional-scholar-is-dead-at-64.html)

The Court can overturn Roe while repeating the words the Court had used on a previous occasion in which it overturned a precedent. In Olsen v. Nebraska, 1941, the Court overturned a 14-year-old precedent, Ribnik v. McBride, 1927, and as it overturned the precedent, it said:
"In final analysis, the only constitutional prohibitions or restraints which respondents have suggested for the invalidation of this legislation are those notions of public policy embedded in earlier decisions of this Court but which, as Mr. Justice Holmes long admonished, should not be read into the Constitution. Since they do not find expression in the Constitution, we cannot give them continuing vitality as standards by which the constitutionality of the ... social programs of the states is to be determined."

Plessy v. Ferguson, 1896, was repeatedly upheld as a precedent for over 50 years, until it was finally overturned in Brown v. Board of Education.
