I kind of believe they will either overturn it something similar.

I believe they're going to keep the TRO in place, but I'm not sure if they'll overturn the EO or not.

I'm leaning towards them overturning.

Judging by how the oral argument is going, overturn. The judges seem rather unpersuaded by the Trump adminstration's case.

Yeah, the judges don't seem enthused by the Trump Admin's arguments

Anyone else listening to the case live.?..this Trump lawyer is getting hammered by the judges...he's stuttering and stammering all over the place like a fool.

Where does Trump find such incompetent people?

After listening to the DOJ's oral argument, I'm convinced that the 9th is going to overturn this EO.

I think any parts of the EO that apply to people who have already previously been admitted to the United States will be toast. Whether the whole EO will be overturned is a tougher question, but I'd lean towards the 9th overturning it after learning more about the arguments on both sides on the establishment clause issue and after listening to some of the oral arguments.

I wish Noah Purcell brought more evidence, the judges don't seem to thrilled he didn't. Especially Judge Clifton.

Why? What's happening?

I could only listen to the beginning on my way to class.

I don't think they'll side with Trump, but basically the judges wanted more proof instead of accusations, and Purcell didn't have it.

Time for everyone's regular reminder that trying to predict a court's ruling based on a judge's questions at oral argument can kind of be a crap shoot unless you really know a particular judge well.

Exactly, and all three have ambiguous history.

Noah didn't bring a lot of hard evidence that this is a religious ban

Clifton sounded like he's support the government

Friedland sounded like she'd support Washington

Canby sounded like he was meh about it all.

I watched some of that, and it is really obvious that the older man who was appointed by Carter will be the swing vote here, and it seems to mostly be about whether or not to extend the stay.  The bottom line is that this is going to SCOTUS.

I should know this, but I will take this opportunity to stick my head out and find out:
What is the 9th's reputation that you are referring to?

It also has a reputation of a majority of its decisions being overturned by the SCOTUS

If I had to guess, I'd say this goes 2-1 in favor of the plaintiff.
