This is an oft-repeated line by prosecutors, suggesting that their hands are tied by what laws legislators pass, but here's the thing: Prosecutors do pick which laws they enforce. They do it every day. Prosecutors have freedom to choose whether to file or dismiss charges, and they often have several overlapping criminal statutes to choose from, allowing them to overcharge or undercharge a defendant as they see fit. For a defendant, this can be the difference between misdemeanor possession, possession with intent to distribute, or drug trafficking and distribution. If a defendant agrees to take a plea deal—and an overwhelming percentage of defendants take the deal because of the leverage prosecutors wield—prosecutors can make more serious charges disappear.[/quote]

Great news!

Most of the war on drugs is an abject failure. Its time we stopped regulating what people put in their bodies, for the most part.

It is good to see America going back to it's libertarian roots.  First gay marriage, now weed...next thing you know they'll start rolling back the dumber regulations, stop invading places and building stadiums so billionaires have a place to watch their millionaire employees play games.

Decriminalizing is a great focus for places that don't have the support to legalize

Just wait..."small gubmint" Abbot will probably ram through a bill in the legislature stripping cities of the ability to decriminalize possession of weed

This is going to be the political battle of the future especially after Charlotte bathroom law. Cities are going to start wanting more independence from the state government.
