AN ACT
to repeal ineffectual prohibitions
of marijuana, and to provide for
the safe and regulated consumption
of the same

Section 1 (Title)
i. The long title of this Act shall be, the "Legal Use of Marijuana Act of 2017." It may be cited as the "Legal Marijuana Act" or as "LUMA."

Section 2 (Decriminalization)
i. All State and Municipal prohibitions on the production, sale, and consumption of Marijuana are hereby repealed.
ii. The prescription and use of Marijuana for medicinal purposes is herby permitted.
iii. Private employers shall have right to establish such rules and regulations for the possession or consumption of Marijuana by their employees on company premises; but the private possession or consumption of Marijuana, except as shall be demonstrated to adversely affect performance, shall not be grounds for dismissal of any employee.
iv. Private institutions shall have right to prohibit the consumption of Marijuana on their premises.

Section 3 (Regulation)
i. The purchase or possession of Marijuana by persons being fewer than twenty-one (21) years of age is hereby prohibited.
ii. The operation of motor vehicles while under the influence of Marijuana is hereby prohibited, and shall be subject to such penalties as are provided for the operation of motor vehicles while under the influence of alcohol.
iii. The production or sale of Marijuana by unlicensed growers and distributors is hereby prohibited, and shall be subject to a maximum fine of $10,000.
iv. Licenses for the production and sale of Marijuana shall be issued by the relevant agencies of the several States, upon verification that the applicant is in compliance with all relevant State and Regional regulations. Licenses so issued shall be subject to renewal every three (3) years.
v. Should an applicant be denied license under Section 3, clause iii of this Act, on grounds of failure to comply with a particular regulation of a State which the applicant should find onerous or unreasonable, they shall have right to appeal the decision of the licensing agency to the Circuit Court.
vi. The importing of Marijuana produced in territories under foreign jurisdiction is herby prohibited, and subject to fines not less than $10,000 and not exceeding $100,000, and to imprisonment for a period not less than one (1) year and not exceeding ten (10) years. All Marijuana thus imported shall be destroyed.

Section 5 (Implementation)
i. This Act shall take effect with the 2018 Fiscal Year.
