Posted in another thread - Jeff Merkley, the most awesome Senator after Bernie today - Went against a hostile Morning Joe & owned the damn panel, arguing about restoring the sanctity of the SC by re-nominating Garland, Gorsuch's horrible view on the Truck Driver case. He destroyed McCaskill's ridiculous point about the danger of the nuclear option

Merkley above Warren in 2020 if Bernie doesn't run !

Merkley was flat-out wrong about this determining the 5-4 balance... which he said was his reason to join the filibuster. He's replacing Scalia.

If you're going to make a stand, be honest about why you're making the stand. He sounded very hackish, trying too hard to appease activists, and unfortunately it looks like he succeeded.

Clarence Thomas, one of the most extreme conservative judges ever replaced Thurgood Marshall, a strong liberal in his times & political climate.

David Souter was a moderate conservative, Sotomayor replaced him & was a strong liberal.

RBG, a strong liberal replaced Byron White who went against the liberal consensus in Roe vs Wade & a range of other decisions.


Scalia is dead, the SC is 4-4. That seat was Obama's to nominate. Now any party will block the President from a SC nominee if they have the Senate Majority. If the GOP can block for 1 year, Dems if needed in the future will block for 2 years or more.

Where is this weird idea coming from that the President will nominate a judge in the same mould - It never happens - You could look at Alito or any other judge ! Why would a President be dumb enough to nominate someone from the opposite end of the ideological spectrum to keep the mould?

We're not talking about RBG's seat.
We're talking about Scalia's seat.

I watched Morning Joe this morning (which is rare).

I watched the Merkley interview.

The only thing from the interview that stuck out to me is Merkley saying THIS appointment determines the make-up of the court and could shift the balance, saying it's currently 4-4, and being called out on it. This does NOT shift the balance.

If you're going to oppose Gorsuch (I would probably vote against him), be HONEST about why.

Because they support judicial stability and the apoliticization of the Supreme Court?

The idea of an ideological and political Supreme Court is becoming more and more a reality. I wish that we would just nominate someone in the same mold of the deceased/retiring/previous judge from now on, but more apolitical and less ideological/political. Unfortunately, that is now considered stupid, insane, and "dumb."

Other post-WWII candidacies from general election losers are Stevenson 1956 & 1960, Nixon 1968 (only winner), Humphrey 1972, McGovern 1984 (LOL).

So the lesson is when this weird occurance does happen the candidate is usually at least a contender. I have no doubt that Hillary believes she can thread the needle and win in 2020.
