Dumb.

Porn is bad for you regardless, though.  Stop watching it.

This won't even be voted on in 1 state. The industry and the consumers will target and crudely torture anyone who votes for it. Plus most of the legislators probably won't be interested in paying the tax themselves.

Its cute when uptight conservatives try to do something like this, but this is DOA.

Unconstitutional content discrimination. First Amendment K.O.s bill in 1st Round.

Federal preemption. Supremacy Clause K.O.s revived bill in 2nd Round.

Any draft bills printed on paper are worth as much as Zimbabwe money.

Yeah, this is literal virtue signaling.  Only difference is that it's hypocrite Christians trying to make up for that time they were caught with one of daddy's Playboy covers instead of radical feminists looking for moral high ground.

How are these laws supposed to be enforced, anyway?  Porn is one of those things you can't explicitly define, but at the same time know what it is when you see it.

Go for it. This would be the 21st century equivalent of the Tea Tax. The Trumpistas will dump all their fleshlights and hentai pillows into the ocean in protest.

Who gets to define what porn is under this law? Are we going to get local "porn boards" who just watch saucy videos 8 hours a day and declare it "porn" or "not porn" for taxation purposes?

The only kind of porn that should be allowed is porn where people are fully clothed.

I prefer furries personally.

A full ban would make more sense, but this is better than nothing.

"I know it when I see it".

Also, is there sales tax on porn DVDs?

Makes sense. If you try to ban abortion, you should morally have to ban masturbation, too.

Obviously unconstitutional. Imagine if a state legislature passed a law saying all internet devices sold in the state must be default block websites that favored the opposing party but you could pay a fee to disable that so therefore it's not censorship. Legally this would be considered the same. Not going anywhere.

I concur. Porn has gotten really abhorrent now. I mean, just look at this sick stuff. No one should be allowed to see things like this...

Does this constitute porn?

(apology for the nudity, but blame Michelangelo Buonarotti for this):

Does this?

The Supreme Court has already declared the SLAPS test valid in ruling out certain objects as legitimate exclusions from the category of actionable pornography:

Serious Literary, Artistic, Political, or Scientific content

The line is blurry. Child porn cannot pass the test, but that is about it.

Anyone who wants a porn filter is welcome to get it.

Taxing legitimate expressions in a discriminatory matter would seem to violate the First Amendment.

This of course, though I don't see why online porn subscriptions shouldn't be subject to sales tax. They might be already. I dunno. People who pay for porn online probably are creeps anyway.

I agree, but I think this is substantially better than nothing. This is quite a leap to have to fend off. Probably a better avenue than anything I had conceived.
