No, but the circumstances were somewhat unusual. Typically, judges planning retirement do eschew picking new clerks.

Makes sense. I had a vague memory that she didn't do this and it was unusual.

Boys and girls, Trump may literally pick 3 total justices in his first (and maybe only) term.  Not one will be older than late 50s because he wants his legacy to be long lasting.  Hell Gorsuch isn't 50 yet.  The White House Counsel's office I'm sure has a rather decent size list ready to go for what may end up being 2 more picks.

I was thinking Hardiman but Sykes would be a likely pick. But yeah, I think Kennedy will retire in two months. He's wanted to retire under a GOP President. He's sided with Roberts and Rehnquist in like 94% of cases.

what? Biden? I'm just hoping they stay healthy until Trump is gone. Cannot have another Republican right wing justice.

That may be right Cashew, but it's still no cause to use a thread about Kennedy's possible retirement as an excuse to further browbeat her. If anything, his retirement strengthens the argument her decision will have no impact on whether there's a right-wing takeover of the Court.

Perhaps, her most selfish (as well as short-sighted, self-aggrandizing, and unprofessional) moment came when she broke with protocol to denounce in a vulgar fashion Trump's nomination, making him a hero-martyr among the disaffected who voted for him and helping him become President.

Remember that Ted Cruz said this back in February at CPAC as well.  My guess would be Kennedy, which would set up the biggest political fight in decades.

If this is true, I really hope it's not Kennedy. Replacing Kennedy with a Trumpist would make the SCOTUS virtually never rule left, aside from unlikely cases like Roberts' vote on Obamacare.

As for Ginsburg, IIRC she considered retirement in 2012-4 when Dems had the Senate, but she thought Obama couldn't get an ideologically similar justice past the Republican obstructions in the Senate. Also, while no one would have expected Trump to win, there is a history of the Presidency alternating two terms for each party.
