This is not a good set of facts for the funeral home. In fact, each and every one of them is exacerbating. There seems to be clear breach of contract. The issue is whether a tort lies (that is where the big bucks lie), and this FH seems to have done its best to generate one. That's the good news. The bad news, is well, a local jury will be involved unless summary judgement is obtained. That might be doable for the breach of contract, but unlikely for the tort. We shall see.

Oh, and what set of religious beliefs holds that dead gays should be not cremated? Maybe the FH got SSM and cremation mixed up or something.

I'm considerably libertarian on this issue and I can marginally, just barely imagine a situation in which a funeral home might legitimately want to avoid hosting the ceremony on religious grounds, since those often have a religious flavor to them. But for corpse preparation and cremation?  Even my stridently libertarian side can't find any reason to not want to make some money for those services.

Obviously not in every case. But this story doesn't pass the smell test. Obviously every funeral home buries gays all the time, so this story is either made up, or the funeral home changed their policy recently to not serve gays after serving them for years.

I guess it's possible that one rogue employee did this on his own, or they did it on purpose to become Co service folk hero millionaires like sh**tty Pizza in Indiana, but it seems unlikely.

Harry, it wouldn't surprise me in the least that this is the first time that this funeral home had been asked to provide service for a same-sex widower. So this doesn't seem the least bit implausible.

That assumption is not at all obvious, and is probably quite wrong. This is a funeral home in rural Mississippi, probably the last place in the country you'll find gay couples, and same-sex marriage has only been legal there since 2015, i.e. 2 years ago. I would be shocked if this funeral home had buried someone in a same-sex marriage before.

It's possible they've buried people who were gay before, but unknowingly because that person wouldn't have had a legal spouse on the form and this being southern Mississippi, no one would have talked about it.
