As the assault candidate and a lawmaker, Gianforte can put his newfound powers and unique perspective to work for all of us. I for one applaud his assault and think we need more of it. Second, he can introduce a bill legalizing the breaking of the law. I for one applaud his lawbreaking as well. Never have we had such a special lawmaker as him. The people of Montana are to be commended.

Assault in a MPC (Model Penal Code) state, like Montana or NY, is Battery in a Common Law state like Wyoming or Florida.

What is called Assault in CL states is called "Menacing" in some MPC states.

Those are just the common law terms. Lots of states have merged assault and battery by statute or define them differently. I would hazard a guess that Montana does not follow the common law on this point.

I wish that Greg Gianforte or any other Republican would introduce a bill decriminalizing marijuana or a bill restoring voting rights for people convicted of non-violent felonies.

How about a bill or something that, if you were arrested on some bogus charge and then acquitted or never even charged with a crime, the arrest record or anything relevant to it would not be public record or be expunged?

There's federal law for this but only applies in areas where there is federal jurisdiction. So technically no, federal law doesn't ban what he did; but he could hypothetically push for a law to legalize assault on federal land.
