Rape
Manslaughter
War Crimes
Indentity Theft
Assault
Breaking and Entering
Drunk Driving (not necessarily a jail sentence first offense, just probation
Adultery (shouldn't even be against the law)

While I agree with you in the fact that Adultery shouldn't land one in jail I certainly think it should be taken into consideration in divorce, custody, child support cases.

While I agree with you in the fact that Adultery shouldn't land one in jail I certainly think it should be taken into consideration in divorce, custody, child support cases.

It can be used as a bargaining chip I suppose to appeal to the human feelings of an impartial arbitrator ruling on the result of a divorced marraige.  But it shouldn't been seen as against the law.

Though some of these sort of over-lap...war crimes would typically involve both murder and child molestation.

Manslaughter = 5-20 years, pay for funeral arrangements (this for first degree manslaughter only)
Rape = 15 to life, pay hospital fees AND a massive fine
Identity Fraud + Theft = 10-15 years, pay a fine
War Crimes = 25 to death
Child Molesting = 25 to death, pay for counseling, hospital fees AND a f***ing huge fine
Adultery = stern warning from police officer, alimony Tongue
Assault = 5-25 years, pay hospital bills
Drink driving = no other crimes? License revoked, a stiff fine, maybe 6 months-2 years for more serious cases
Breaking and Enterring = 1-5 years, pay for damages

Funeral arrangements are normally religious in nature. The government should not force private individuals to fund religious ceremonies.

I would put breaking and entering ahead of adultery.  I would also put child molesting ahead of rape.  Otherwise, I generaly agree, though I could be convinced to put assault ahead of some forms of drunk driving.  I guess it depends how drunk.

"Assault" is just threatening to do physical harm. The actual physical harm done constitutes "battery" (at least in most jurisdictions). Perhaps this misunderstanding has led to the different ranks given to the crime.

I don't see why adultery should be a crime.

"Assault" is just threatening to do physical harm.

The legal definition is either that or an attempt to do harm - assault without battery can be sort of like attempted murder if it's the second one: you meant to hurt the person, but failed.

I think the misconception arises from the fact that the non-legal definition of "assault" is "a violent physical or verbal attack", which in most people's minds would probably imply that damage was actually done.

examples:
Child Molesting
Adultery
Drink driving
Breaking and Enterring 

except perhaps identity theft because that is pretty
serious

This is beyond insane.
