The surname Roberts is there twice, so am I correct in assuming you mean both John Roberts and Owen Roberts?
How on Earth anybody could consider Joseph McKenna one of the 10 best Justices is beyond me.....

William Brennan
Thurgood Marshall
Sonia Sotomayor
Ruth Bader Ginsburg
Hugo Black
Earl Warren
John Paul Stevens
Harry Blackmun
Louis Brandeis
William O. Douglas (mostly for a tenth)

Holmes wasn't awful, but I thoroughly detest his opinion in Schenck. I suppose the same could be said of Justice Black and Korematsu (in my opinion, the worst decision ever handed down by the Supreme Court), but he did make up for it in a number of decisions (particularly Alexander v. Holmes County Board of Education).

Scalia

Bump from a while ago, I know, but this post got me curious.

Why such the low ranking for Scalia on crim pro?  Law school was a long time ago for me, so the details are fuzzier than they used to be, but I found Scalia to be rather good on the 4th, perhaps one of the areas where I would find him to be most on point (certainly more so than his schizo approach to the commerce clause).

Scalia is actually pretty good on criminal procedure, by my admittedly liberal metrics. Still, he's pretty conservative, for my standards, compared to the others clustered toward the top.

Some feeling about his decisions in other areas, like the equal protection clause, may have also snuck in...

1. Why would a self-professed reactionary like Owen Roberts, the turncoat responsible for legalizing the Second New Deal?

2. Why would anyone like Joseph McKenna?

What is your favorite part about Justice McReynolds? His anti-semitism, his misogyny, or his racism?
