This is a pretty good example of Trump populism. It's presented as "common sense" but you very quickly realize it's anything but.

The alt-right wants to sacrifice military capability for their social experiments. That's what's happening and that's how Democrats should respond to it.

Yes, looks like. The last time the mil never got any guidance, only political BS without the guidance. This time, once the guidance is promulgated, since it is from the CINC, it will be an order and implemented.

Its bad in the sense that if the tg SMs fill a critical billet and are admin sep'd then they would have those billets gapped while waiting for a replacement SM. It would be assured, but depending on where that SM is (boot, still in school, assigned to another unit but ready to go/transfer), it is a time issue and time is an enemy when dealing with proper staffing of critical billets.

Trump is too egotistical to be humiliated.  Also, it's doubtful that any lawsuits would succeed. Unless Congress has specifically required something under its Section 8 Clause 16 powers, in how the military does things, the President as Comander-in-Chief has extremely broad powers in deciding who can be in the military.
