I can see the court case (if one happens) to base it on discrimination of procedures, singling out one vs. allowance of all care, esp if done via TriCare/VA/base hospitals. Does the DoD have the right to prefer certain care in the overall structure as opposed to all? Would be an interesting SCOTUS case.

This one's not getting fast tracked to SCOTUS.......and it will be interesting to see if they even want to go there.

I though the military wasn't fully subject to some Constitutional protections. DADT was repealed like 10 years after Lawrence v. Texas?

It's essentially within its own branch of federalism, separate legal system (UCMJ), separate chain (answerable to CINC), but funded by the taxpayer through Congress.

I partially see the logic in this, but it just seems like it's the mean spirited brainchild of some hyper hawkish gung ho general.

Being transgendered seems absolutely grueling. Not only will you have to deal with bigotry that is much fiercer than just garden variety homophobia, but also with a large degree of internal turmoil. Gender identity shouldn't hinder any individuals ability to serve if they're physically qualified. If they can pass a physical fitness test and have none of the drama/baggage that many (but not all) of the transpeople I know have, why not?

I'm sorry, but the drag queen I met last month manning the "Trans-Liberation Army" booth on the FSU campus is decidedly not fit for service. I've never known a transperson who I could see being taken by the army. But then again, few people in general make the cut. Certainly none of the hawkish Young Republicans I know.

It that was to occur, it would likely be an admin sep, Honorable or General discharge. Both are good but you def want to sep with HON.

War is hell. I'm actually somewhat happy for the transpeople who get to avoid it now, however unjustified the move actually may be.

Mort does have a point that transpeople often, but not always, experience other mental issues. I fully trust the army to screen those people out. A blanket ban is just unnecessary.
