The statement she made above is a fact. If she believes that the Fourteenth Amendment requires proportional representation, she should not even be a lawyer, let alone a Supreme Court Justice.

Which is why she will be asked about her response during the hearings so she can explain her position/motive in that statement.  Really, this is nothing to get bent out of shape over.  It's a little blurb on a questionairre, and not detailed testimony.

The Voting Rights Act is part of the congressional enforcement of the 14th amendment.  In a city with a large minority population, subject to DOJ pre-clearance, the VRA practically requires racial proportionality.
