Glad to see he has the right view on apportionment.

"One man, one vote" actually had nothing to do with any of those activist Supreme Court decisions. The Court just pulled the phrase out of its ass to disguise their blatant disregard for the rule of law.

Biden has obviously either failed to read Section 2 of the Fourteenth Amendment, or has conveniently chosen to ignore it. I'm glad to see that Alito opposes Reynolds v. Sims (although Baker v. Carr--dealing with the procedural question of justiciability rather than the substantive question of apportionment--was alright).

I can vaguely and remotely understand how some people believe that the Bill of Rights protects a right to privacy. I cannot, however, understand how anyone could argue that the Fourteenth Amendment protects the "one man, one vote" principle. In plain English, that amendment recognizes that the right to vote may be "denied ... or in any way abridged" by any state.

Well, Reynolds didn't confer voting rights upon anyone. There was really no connection to the phrase "one man, one vote" (all voters already had one vote, and one only). Rather, it was all about destroying geographic representation.

Indeed. Reynolds was one of the most obviously "activist" decisions ever made. Harlan's brave dissent is perhaps one of the greatest in the history of the Supreme Court.

Biden's comments, assuming he actually wrote them himself and didn't plagerize them from some British Labour party staffer, are taking Alito's position wildly out of context.

The Warren Court engaged in some hugely strange racial gerrymandering, creating a number or utterly irrational congressional districts solely for the purpose of ensuring the a specific racial minority would win the seat.

Ironically, these decisions have actually hurt the Democrats in the long run.  The Democratic vote is so massively concentrated in a few districts that often the GOP gets more seats in a state than they would otherwise likely get in a non gerrymandered situation.

For example, in Pennsylvania (somebody check these numbers I may be out by 1 or 2) the GOP has I believe 12 of 19 seats in the House, even though to state as a whole has a mild Dem lead in terms of total vote. - The Dems "waste" a lot of votes by getting massive margins in the Philly seats, while the GOP wins the non city seats by smaller margins...

Florida would be another good example, where racial gerry mandering has packed the Dem vote in Dade, Droward, etc

In one of those comical moments in life, I believe there are a few cases before the court when the GOP is supporting the Warren Court racial gerrymandering, while the Dems oppose it now...
