Correct, but likely overbroad. Given the circumstances, Furman's conviction probably should have been overturned regardless of whether the death penalty was involved.
Gregg v. Georgia, specifically the Woodson v. North Carolina and Roberts v. Louisiana cases that were consolidated into that case.
