Amendment to Allow the Senate to Set a Minimum Wage
Originally introduced by Gabu.
Reintroduced by Gabu.

Article I, Section 5, Clause 9 of the Constitution is modified as follows:

"To fix standards of weights and measures and of such items of commerce, and to set a minimum wage, as it deems neccessary throughout the Republic of Atlasia."

I am particularly concerned that by modifying a clause within the Constitution we will modify the meaning of the rest of the clause by seemingly detaching payment of wages from commerce. This is something that I wish to avoid as we may provide an excuse for the Supreme Court to detach the entirity of labour from the meaning of commerce.

I motion to strike the text as it stands and replace with:

The Senate shall have power to to set a minimum wage, as it deems necessary throughout the Republic of Atlasia.

If that fails I would like to motion that the Amendment spell "neccessary" correctly.

Scratch that pre-emptive 'Aye' vote on my part. I'm having a bad day Sad (real-life stuff)

However, there's no question of my opposing any amendment which would permit the Senate establishing a federal minimum wage because it is my firm conviction that there should be one, which is why I never liked the Bono vs Atlasia II Supreme Court ruling, which struck the Fair Wage Act down


I motion to strike the text as it stands and replace with:

The Senate shall have power to to set a minimum wage, as it deems necessary throughout the Republic of Atlasia.


For the reasons you have stated, Senator, your motion makes sense Smiley and it's my intention to support it

I am in favor of Senator Bell's amendment; it makes sense to simply add it on rather than writing it into an existing clause.

The problem is that federal law explicitly declares that labor is not an item of commerce. Under Title 15, Section 17 of the Atlasian Code, "The labor of a human being is not a commodity or article of commerce." The same judgment is reflected by the New York Bill of Rights, which proclaims, "Labor of human beings  is not a commodity nor an article of commerce and shall never be so considered."

Whether the Supreme Court's decision was right or wrong can be debated. Personally, I do not find the decision very convincing. But the vigorous attacks on the ruling as being totally unfounded, as unworthy of the Court, and so forth, are in my opinion excessive. Even those who oppose it should recognize a plain fact: the federal government, as well as the governments of several states, have declared their opinions that labor is not an item of commerce.

I believe that the Northeast has not set a minimum wage, though it did consider it. Hopefully the federal minimum will only serve as an ultimate safety net and would only be relevant in situations where there is no minimum wage or it is very low.
