Per Section 4 ("Sudden Death Tie Breaking") of the Unified Electoral Code Act:

If Section 3 fails to yield a winner then candidates shall have the option of using one of the following methods to break the tie:
   1. Senate Vote: The Senate shall vote to break the tie under quorum rules, with the Vice President casting a deciding vote as necessary.
   2. Term Splitting: The candidates in the tie shall agree upon a schedule according to which the candidates shall divide the term among themselves. The schedule shall be allowed to be whatever the candidates agree upon, provided that its total length does not exceed the term to which a candidate would have been elected to had he won in his own right.
   3. Failure to Agree: If within one week of the necessity of Sudden Death Tie Breaking being known, the candidates have not agreed on a method to break the tie, then the method described in Clause 1 shall be used to break the tie.


Whereas the candidates in the District 1 runoff election have for the past week failed to agree to any method of splitting the term, the Senate is charged with seating one of these candidates.

Senators, please vote for one of the following candidates (or rank the candidates preferentially if you so desire) to join your ranks as Senator for the First District:

This is kind of murky. The "date" was last Friday. I believe the Senate would be wise to make the vote official to avoid any possible legal issues later. Also, once the week deadline passed last night, the law requires that the Senate settle the matter; it was out of the candidates' hands at that point.

I urge the Senate to complete the vote it started.

I believe Mr. NixonNow later retracted this statement and has not come forth after either of the elections stating his intentions as thus. It is in my opinion that in order for the election to be legal and binding the Senate must finish its vote concerning the District One election.

When did he retract it?  Are you making this up?  This statement, as you know, was made just prior to 2 in the morning today.  I see no post of his on that thread taking back what he said, and I do not recall seeing any new thread where he said he is retracting it, unless -of course- he told you this privately.

When did he retract it?  This statement, as you know, was made just prior to 2 in the morning today.  I see no post of his on that thread taking back what he said, and I do not recall seeing any new thread where he said he is retracting it, unless -of course- he told you this privately. 

Oh, I was confusing this with an earlier statement by the candidate stating that he would not accept if he won which he later retracted. I did not see this statement.

The Senate, having reached a quorum, has voted to seat EarlAW as Senator for the First District.  He may now take the oath of office.
