I really don't see a problem with it. You shouldn't have to risk unemployment in case you lose an election just because you have the misfortune to have to run for both in the same year. That's an unfair disadvantage.

Yeah, I forgot about Biden, he shouldn't have been able to do it, either.  But the difference is Lieberman and Biden were running for re-election as well as running for higher office.  DWTL would be running in two elections for the same office.
