Half the teenagers in the country would be in prison if this law were universally enforced and everyone who did it was caught. Georgia, like many other Southern states, is ages behind the rest of the country as far as sex laws and sex ed go.

Oh, I should have actually read those stories before I commented. I apologize.

Anyway, then maybe the law isnt bad, but the punishment is.



mhm, it's quite excessive. iirc, the legislature actually passed a law making statutory rape a misdemeanor if the couple are within 4 years of age, but it took effect after this guy was sentenced.

This reminds me of another isane Georgia case.  don't remember the kid's name, but an 18 year old male senior (who was black) had consensual sex with a 15 year old white girl, whose father was a known racist, and the kid got charged and sevred jail time over it.  This is what actually led to the change in the law bacon king was talking about.

For the record...I don't agree with the 10 year sentence if the kids are within 24 months of age...if within 24 months, I don't think it should be a crime.

They are wasting tax money on prosecuting a case where there was no real damage from the crime.

The prosecutor does not have to file charges to satisfy his obligation as a job.  Not everyone who commits with a crime is charged; obviously, it's a judgment the authorities make, and quite clearly the wrong judgment was made here.

Ridiculous. Utterly ridiculous.

A while ago I remember watching Bill O'Reilly's show and he was talking about child predators who get light sentences. A man in Alabama raped his 12 year old adopted niece, got 2 months in jail. In Missouri a man who raped an 8 year old girl got 3 months jail time. A child predator in Montana raped a 3 year old boy, causing him internal injuries, sentenced to 5 years.

Notice, out of the cases I discussed, no outrage or disgust from do-gooders who think punishing a 17 year old for consensual sex is a good thing. Come on, there is no excuse for priding yourself on being tough on sexual immorality and letting child rapists off the hook.

You know, it's rants like this that send the Cynicism Meter crashing through the roof. Tongue

Considering that the age of consent in Georgia is 16, it was not consensual.  It is having sex with a minor, which is against Georgia law.

16-6-3.
(a) A person commits the offense of statutory rape when he or she engages in sexual intercourse with any person under the age of 16 years and not his or her spouse, provided that no conviction shall be had for this offense on the unsupported testimony of the victim.
(b) Except as provided in subsection (c) of this Code section, a person convicted of the offense of statutory rape shall be punished by imprisonment for not less than one nor more than 20 years; provided, however, that if the person so convicted is 21 years of age or older, such person shall be punished by imprisonment for not less than ten nor more than 20 years; Any person convicted under this subsection of the offense of statutory rape shall, in addition, be subject to the sentencing and punishment provisions of Code Section 17-10-6.2. (c) If the victim is at least 14 but less than 16 years of age and the person convicted of statutory rape is 18 years of age or younger and is no more than three years older than the victim, such person shall be guilty of a misdemeanor.


Maybe the 17-year-old should have gotten 20 years instead?
