One of my co-workers described a case where three miners fell down into a pit and weren't able to get out.  After eight days they drew straws to be eaten-one guy was eaten.  Ironically shortly after they ate the miner, they were rescued.  The other two were punished for manslaughter.

I wouldn't punish them because both sides consented and they were in a panic situation-although it'd be a hard thing to prove.

Cannibalism in extreme cases of survival is much different than voluntary every day cannibalism.  However, the person must already be dead before you decided to eat them.  Murder is murder.

Second degree...there's nothing first-degree about this, really.  But I agree, it's murder (probably plead down to manslaughter).

First degree murder means that it was premeditated and done in cold blood.  Unless you can prove that one or both of the miners specifically intended to be trapped there purely as a guise to kill the other miner, the most it could possibly be is second degree murder.

Well, that's why you go to a court of law, where people are presumed innocent until proven guilty.

I think I'd rather starve to death than eat human meat.  I simply can't see myself being able to eat it, no matter what it tastes like.

There was actually a case a bit like this over here in the 19th century; though it involved two sailors on a lifeboat eating the cabin boy. I think they were hung for it, though I can't quite remember. Maybe just imprisoned.

What if the person who drew the shortest straw changed there mind about wanting to die? If they said "too bad" and killed him anyways they should be punished.

And there no way of knowing what really happened. Both the people who killed him might have intended to say "just kidding" if they lost. Drawing straws for your life isn't an enforcable contract.
