Anti-CARLHAYDEN Bill

Section 1: Current Status of Illegal Aliens
1. No hospital or place of medical care may deny treatment to a person based on their status as an alien or noncitizen.
2. Within two weeks after the passage of this act, employers paying below the minimum wage to illegal aliens shall be prosecuted as if they were paying below the minimum wage to legal workers.

Section 2: Amnesty
1. Any illegal alien who is not suspected of terrorism charges, or has been convicted of murder, rape, or high robbery, may apply for citizenship one month after the passage of this act.
2. No person shall be denied citizenship based on their status at any time in the past as an illegal alien.
3. No person who is an illegal alien upon the passage of this act may be considered for deportation solely because of their alien status, and all charges pertaining towards their status as an illegal alien will be dropped.

Section 1, Clause II is the worst part of the bill. The purpose of having these people here is cheap labor. There's no real point besides that.

I support the objectives of this bill, but would like to make an amendment.

Proposed amendment:
That Section 2, Clause 1 be amended to read as follows:
Any illegal alien who is not suspected of terrorism charges, nor has been convicted of an offence and sentenced to a term of imprisonment greater than 12 months in duration, may apply for citizenship one month after the passage of this act.

Although the bill not only is awful because of its goal, it makes the goal unrealistic.  There is way we could have that mad rush of citizenship.  Plus, it is easy for these people to have escaped crimes or made new identies, we would need indentification that would be impossible to be had most likely.

I propose a few amendments to make sure if passed the bill is at least reasonable:

First Amendment:
Strike Section 1.2 out of the bill

Second Amendment:
Amend Section 2.1 to include all felonies including using fake SS numbers

Third Amendment:
Add a new Clause to Section 2 saying:
Must have been in the country for at least 10 years, hold a steady job or be the supporter of a family

That's ridiculous.  Not even most legal immigrants fit all of those qualifications.  What about a married couple, who are both illegal aliens, who have a child here, (who, under American law anyway, gets automatic citizenship).  The husband has obtained a steady job and is supporting his family.  The wife isn't financially supporting her new child, but staying home with it.  This means the husband could apply for citizenship, but the wife could not.

Abstain.  As I understand it, current law requires the minimum wage to be paid regardless of immigration status, so including that clause or deleting would have no effect.  Of course, it is easier for employers to get away with paying less than the minimum wage to illegal aliens, but that won't be affected by that clause.
