I dont have the case history in front of me, but I'd guess it probably went something like this

2002/03-Cher utters vulgarity, FCC acts, fines Fox
2003 Fox Appeals (my administrative law knowledge is well, non-existent), not sure to the FCC or to Federal district court...
2003/04-Case heard, ruling handed down...either fox or fcc appeals
04/05 maybe 06-Court of Appeals hears case
05/06-Court of Appeals rules...Either Fox or FCC decide to appeal
Since then, been waiting for Supreme Court to take case...or wait to file for right judicial climate etc...then the USSC gets to decide if it wants it

Given the nature of award programs, having the program on a five- to ten-second delay to allow expletives to be deleted is a reasonable precaution that should have been undertaken.  I can't see SCOTUS ruling against the FCC on first amendment grounds, so I expect a very narrow ruling in that case based on the legislative history.
