Oh sure, Texas does a great job. After all, they do have such a low crime rate, obviously a result of law and order, and of course protecting the sanctity of life by killing people that don't respect it themselves. That makes sense.

To put it mildly, the defendant's case here was weak, if almost nonexistant.  So, the showing is not surprising - if not a little confusing because of the splintered opinions.  It looks like to me that there might be the possibility of a successful case in the future, but there would need to be a heck of a lot more evidence than was provided here. 

The amusing part of the released opinion is Stevens recanting any support for the death penalty and Scalia smacking him down on it.

Its difficult since its a death penalty situation, but probably if it was a non DP case the allies of D may have kept it from being brought.

Live to fight another day.

I'm slowly losing my preference for having the death penalty, at least as it currently exists.

As the Constitution currently stands, the SCOTUS did the "correct" thing. It's wasn't their job to rule on the death penalty in general. That's already been done.

And precisely because of that, we need some changes to the Constitution. Executing people shouldn't just be a question of legality. It shouldn't be morally acceptable to anyone. I'd like to see if capital punishment's most vocal supporters would be willing to work as an executioner.

Yes, but it's only a part-time job because the death penalty means you stay on death row til you die of old age more often than not.
