This election is held in accordance with Article I, Section 4, Part 5 of the Constitution and with Section 20 of the Proportional Representation Act.  The absentee voting booth opens at 12:00 PM EDT, July 22, and closes at 12:00 PM EDT, April 24th 2008.

Upon checking, you don't actually need a majority, just the most preferences in the final round.
Well of course. How else you gonna end the counting? You win once you can't be overtaken. There's no "percentage".

First round
BaconKing: 7 votes
Downwithdaleft: 4 votes
Gporter: 1 vote

I declare Bacon King to be elected.
In that case, I contest the final vote total.  BaconKing received six votes as Josh22's vote is invalid having been cast before the booth was opened.

So you're right. Josh's vote has been invalidated. BaconKing still wins, having acquired six votes and still a majority of them.

Haven't checked the facts of the case, but could it be considered to have been an absentee vote falsely cast into the wrong booth?

Well, it would be held too close to the general election to be legal. The weekend it was going to be held on was the last possible weekend it could be held.

If you're thinking of what I'm thinking of (I 4 5 again... "if a vacancy shall occur when there is a person due to assume that office within two weeks, then no special election shall be necessary", that refers to the date the vacancy arises, not the date the by-election is held. And it refers to the swearing-in date, not the date of the general election. It's basically just another way of saying (under the old district rules) "if a guy resigns upon the election of his successor, his successor may take office early".

I've no idea whether the ten days begin anew after the injunction was lifted, in which case the by-election should be next weekend, or whether the time before the injunction also counts, in which case there was no legal date due to problems with the injunction coming in and going out on different days of the week. Smiley

Oh, shoot I missed that post. Well, I really see holding the election as being pointless at this point with another election only a little while away.
Ah, but that's true but irrelevant. (Although having a full Senate is nice, so it's not that pointless really.)

It's also impossible to accept just some write-in votes rather than any and all, as ben's statement can be read to imply.

Not that it matters one jot, of course (and your decision is also in line with the Candidate Regulations, btw. Cheesy )

Hmm, that's interesting. I can't say I agree with that interpretation though that's clearly how past SoFAs have interpreted it.
IIRC there was even a law case about it, way back in the depths of time. Anyways, it's been like that since forever.

The first time, I went AWOL for weeks. Although that had personal reasons I still have never divulged. Several years ago now.
