Sam Spade v. AHDuke (II)
«
on:
August 08, 2008, 10:03:30 pm »
Magistrate Dibble:
I am not challenging whether AHDuke has called a legitimate emergency initiative election under Amendment (Initiative) 135 of SE Constitution.
However, in violation of Article VI, Section 2 of the SE Constitution, which guarantees "equality of rights under the law shall not be denied or abridged by this region, Governor AHDuke has violated this clause, by opening the voting booth with the clear intent to hold to the following restriction, in violation of this provision:
"All members of the Dirty South are allowed to cast ballots except those who have declared themselves members of independent nations."
I also note that this violates Article VI, Section 11 of the SE Constitution, specifically this language:
"All elections are to be free, and every inhabitant of the region with 50 posts or more shall have an equal right to vote in any election. Every person shall be considered an inhabitant for the purposes of voting in the state where he has his domicile."
I also note that there is no method under the SE Constitution or law that allows the Governor to determine who are valid registered voters in the SE to vote in this election except as stated in Article VII of the Constitution.
As such, I request that this initiative vote be declared null and void, and a new initiative vote be started immediately without this unconstitutional restriction. I note that if this case is viewed as not ripe yet, I will file the same case upon certification of the vote.

I'm not sure if this new tendency to appeal to the apparent inherent evil of Xahar in all things even remotely related to forum policing or this damn game is especially helpful.

I expected the vote to at least close before we were dragged into court. The Atlasian legal system sure is fast.

This is an open and shut case. I find in favor of the plaintiff. The Governor is in clear violation of the Southeastern Constitution. The vote is null and void.
By the power invested in me by the People of the Southeast, I hereby throw a gavel at the Governor. *throws gavel at Duke*

They have stopped nothing, halted? Perhaps
What a bad ruling, if I wasn't sure that SC wouldn't rule the same way I might bother appealing. These two revoked their SE citizenship when they left the region. Duke didn't do anything wrong, he counted the votes of those that are members of the Dirty South. Everyone is clamoring at the four of us that we will prosecuted to the fullest extent of the law (blah, blah, blah), but we should justa allow these traitors their votes? I think not and I hope Duke overrules Dibbles decision and certifies the vote anyway.

I'm sorry, but I don't see why I have to count votes of people who declared themselves part of another region. They seceded from the Dirty south. The claus says any inhabitant of the region. The Republic of whateverthehell Hashy is calling it is not part of the Dirty South. The same goes with Andy Jack. You can't leave and then expect to still have a say. This goes for Xahar too, who thinks he's part of EVERY region.

People have a hard time understanding that both me and Andy have renounced our coups and have returned to the Southeast in an attempt, which seems futile in the wake of the new totalitarian leadership, to organize a Unionist movement.

1. There is no region called the "Dirty South". That is a delusion on your part. This court recognizes the region known as the Southeastern Region.
2. There is no Republic of whatever and it isn't recognized by this court either. The area which constitutes the Southeastern Region has not be redefined by any authority recognized by this court with the power to do so.
3. The Constitution clearly states that those inhabiting what is recognized as the Southeastern Region shall be allowed to vote. If these supposed breakaway regions are within what is recognized as the Southeastern Region, those inhabiting them are still considered inhabitants of the Southeastern Region and thus must be allowed to vote.
4. The only inhabitants of the Southeastern region that can be denied their right to vote in Southeastern elections are those who have been
convicted
of treason, bribery or any willful violation of the election laws of this state or of Atlasia, as stated in Article VI, Section 11 of the Southeastern constitution. Seeing as I'm the only real court official in the region and I don't remember convicting anyone, much less in a jury trial as required by Article VI, Section 16.
Thusly, you have no grounds upon which to deny any inhabitant of the Southeastern Region the right to vote.

I ask Magistrate Dibble for an injunction on certification once the vote closes until the proper criminal trials can be conducted against Hashemite and Andy Jackson for their desertion of the region.

Denied. The vote is already null and void.

No, not happening. Instead, as Magistrate I order the formation of roving death squads who will kill all in earshot who use that phrase. [/joke]

Denied. Do so would be a violation of Free Speech. Neither the Federal nor Regional Governments have the power to do so.

It would seem to me that the rogue region can conduct all the rogue elections that it wants. It is when such "elections" have any consequence, that the legal machinery should kick in. I don't see quite why the federal government has a role of the fun and games in the regions, unless and until it affects its integrity or its Constitution is compromised.
What will never happen if I have anything to do with it, is having anyone voting in federal elections, or elected to federal elections, who does not recognize the supremacy of federal laws. That dog won't hunt. The rest is open to debate.
