I agree - I think it's despicable, but it's not a hate crime.  A hate crime has to at least threaten violence, and I don't think this does that.  Even if it were against Obama, I don't think it should be prosecuted as a hate crime.

very poor taste, and I wholeheartedly dislike anyone who sets up such a stupid Halloween display, however...I don't think it's possible to be defined as a hate crime.

Actually, in Mexico this would have been considered not just in good taste, but absolutely normal. For the Day of the Dead you'd find skeleton dressed up as the president, a fake death notice for his wife, and a made-up grave of an opposition leader (complete, with a tombstone) all over. This is, indeed, considered innocent fun. But then, kids in a nursery school put up "their own" skeletons, which they spend weeks making led by their teachers.

Politico had it earlier. These things happen in election years; people are morons. The racial overtones of the Obama effigy are somewhat more menacing than the message of the Palin and McCain effigies, but both are just done by fools.
