There are two differences between the Propositions. 22 was a statute, while 13 is a Constitutional amendment. And gay marriage was not legal at any point in 2000.

Prop. 8 is currently at 52.2% (votes still being counted), which is 9.2 points worse than Prop. 22. It did worse in every county, with only a 4 point drop in Alameda and Imperial counties, but a 20 point drop in Alpine county.
