Sorry, but, conviction of a crime is not necessary for impeachment, and removal from office.

Ask Evan Mecham (well, he's dead now), who was not convicted of any of the bogus charges brought against him (he won in court), but who was impeached and removed from office.

The present votes and those not voting are important. In IL it requires 2/3 of the 59 members, which is 40 Senators. Some combination of no, present, and not voting that equals 20 would keep him in office. Personally, I think that's a hard number to reach.
