My question wasn't supposed to be about the Constitution...but rather, what you would choose if you really could determine it.

That said, I also favor trial by jury.

     One could take the position that juries are too legally uneducated (no matter how many instructions the judge gives them) to be relied on to consistently render sound decisions. My mother has told me enough horror stories about idiotic juries that I could sympathize with that position, even though I disagree with it.

I'm torn.  I like the idea of a jury, and would certainly not want my case left up to an all-powerful magistrate, but jurors don't seem to take their sacred responsibility as seriously as they should.

I suppose I lean in favor of trial by jury.

I agree with this, which is why I said Lean No. Panel of judges (not just one judge).

No, for a variety of reasons. The main reason being forcing people to be on a jury is rather unfair, especially with the crap pay.

Erc made one of the best arguments against jury trials awhile back, I should look for it.
