     Libel in the area of employment is far more complicated than in general law. My mother isn't really an expert in this area of the law, but she is fairly confident that this cannot be extended to affect reporting.

Note, "can sue," versus will prevail in the action.

Traditionally courts are loathe to prevent civil actions, but, once discovery has been completed and a motion for dismissal is in order, absent some showing of extreme behavior, the action is likely to be dismissed.

Essentially what the court way saying is that we will give the plaintiff a chance to show some extreme behavior, rather than sanctioning the plaintiff's case per se.

Violations of privacy, even if the material leaked is true, could be subject to lawsuits.
