The Illegal Immigrant Bill of 2009

Section 1: Replacement
1. F.L. 18-8 is hereby repealed
2. No clause of this Act changes the citizenship status of any Atlasian citizen, whether they are a citizen by birth or by naturalization.

Section 2: State Services
1. No hospital or place of medical care may deny treatment to a person based on their status as an alien or non-citizen.
2. Within two weeks after the passage of this act, employers paying below the minimum wage to illegal aliens shall be prosecuted as if they were paying below the minimum wage to legal workers.
3. The government shall fully fund all services for illegal immigrants required by this law incurred by citizens of Atlasia.

Section 3: Deportation
1. Any illegal immigrant found to have committed or planned to commit a crime or act of terror shall immediately be detained and deported to their country of origin.
2. Upon detention and deportation of an illegal immigrant, any member of said immigrant's family that holds alien status may opt to return along with their family member or remain in Atlasia. This does not preclude the deportation of those aliens that wish to remain at a later date due to separate violations.
3. Detention and deportation may be delayed to allow for recovery from illness or life-threatening circumstances on a case by case basis.

What is the point of section three?

As in, if an illegal resident commits murder, the only thing we're going to do is deport them to where they came from?

Also, how is someone "found" to have committed something anyway? A jury trial or just an ICE agent's say-so?

Depends on the crime. I think we should leave it in the hands of the judge. Our prisons are already over-crowded and incarceration is a costly burden on the taxpayer. For serious crimes, like murder, then yes, they should be subject to the Atlasian penal system. For less serious crimes, deportation may be suitable. We can either list crimes here and whether they qualify, or leave it to the judicial system to answer that question. I suggest that leaving it in the hands of judges to decide whether the circumstances of a particular case warrant deportation, or deportation after incarceration is the better option.

In cases in which the illegal immigrant in question shall have committed a violent crime, deportation shall only happen after serving a prison sentence.



Sorry about that...my original amendment left open the option that a judge might allow an illegal immigrant found guilty of a non-violent crime to stay in the country. That wasn't the intent of the original bill, and it's not what I wanted either.

This is definitely a positive change to the bill, especially in such circumstances that the recipient country has no legal ability to prosecute/sentence them for crimes committed in Atlasia.
