Lean yes.  Sometimes juries won't be willing to give the death sentence in a case which clearly deserves it, and the Judge should be allowed to overrule in that instance.

I'm opposed to the death penalty, but sentencing should be the purview of the judge not the jury. In that sense, yes, it should be up to the judge. At a more basic level, I'd prefer if all states abolished the death sentence which would mean that the judge couldn't impose the death penalty.

I said no because of complete opposition to the death penalty, but I strongly agree with Smid that, if the death penalty is to be legal, it must be the judge and not the jury who makes the decision.

Unless the convicted defendant opted for a trial with a judge but no jury, the penalty (as long a authorized by law) should be the purview of the jury.

Interestingly, defendants who are facing possible capital punishment and who have either declined a "deal" or were never offered one, and who believe they are likely to be convicted, generally prefer trial without a jury, as judges are less likely than juries to impose the death penalty.
