In law school, this is kind of going from the "There isn't anything involving me that's of the court's concern" stage (Answers, MTDs) to "I might have done something wrong. So what." (Motion for Summary Judgment). In a criminal case, these sort of things are skipped and usually there is indictments, habeas corpus deals, or just the acknowledgment of probable cause and first appearance. OTOH, the Emoluments clause stuff to my knowledge has advanced past the dismissals and summary judgment and onto depositions. At any rate, we can now be sure that Mueller's report will at the minimum say that Trump should probably be sued or impeached or sued over all of this. This is an upgrade from simply thinking the minimum thing Mueller could say is that he was and probably  still is "extremely reckless" with who he associates with.

The Trump Crime Syndicate has spent years trying to spin their conspiracy against the United States,  by trying re-define what looks like a criminal conspiracy as "collusion" and then claiming that since collusion isn't a specifically defined crime, they didn't break the law. This is, of course, sheer nonsense - it would be  like an embezzler saying, "I engaged in some non-standard borrowing. Non-standard borrowing isn't on the books as a crime, so I can't be charged with anything!"

If Dershowitz actually believes this is valid reasoning, he's an idiot. If he doesn't believe it, but thinks it will actually work against a functioning legal system, he's still an idiot. But if he's just doing it to help provide some rhetorical cover to the assault of the fascist GOP and the Trump Crime Syndicate assault on our nation, well, that not stupid, it's evil.
