I think that, in it's current form, the Northeast Region Indoor Smoking Ban infringes on the rights of business owners, private property, & of the people to make their own decisions. While I would be open to other regulations of smoking, shush as banning it in all government buildings, I think a broad ban of smoking in all in buildings is too intrusive.

Apparently section 3 was vetoed, and I forgot about the exceptions in section 5, but I still think that whether or not smoking is allowed should a be a decision that's up to the business owner.

I am opposed to repealing the bill as a whole, but I wouldn't mind trying to amend parts of it.  For example, the exceptions in Section 5 could bless strenuous.

Would you care to elaborate? I might be receptive to measures less drastic than repeal. The region would obviously benefit from legislation that bans the use and manufacture of the device pictured in Scott's post.

I simply mean that we should allow these businesses to operate without too much red tape if they truly are what Section 5 specifies.  Also, I think the 50% revenue figure should be lowered to something like 33% - perhaps a bit more reasonable?

Also, as Attorney General, I successfully won the case - SPC vs. Atlasia which deals with an issue almost identical to this one.  Y'all might be interested to see the decision by the court as it relates to this bill .Wink

I don't see why a business should have to sell cigars to allow smoking in their establishment, although I would be open to requiring that a business which allows smoking must not allow admittance to minors.

On its own I could also support the removal of section 2 and fewer restrictions on section 5. At the moment though I'm inclined to vote nay.

Sorry, the public places was a typo, I meant public buildings. I could support that exception.
