Am I correct in thinking there are two open seats and three people running for them?

There are currently two open seats. Should Lief resign or be confirmed to his new job by 5pm on Wednesday, a third seat would be elected in the same election.

You have to be appointed by Ben, so that's a no-go at the moment. Tongue

Just out of interest - when did we overrule the Supreme Court and reinstall common sense? I can't remember voting on a Constitutional Amendment to that effect.

I could swear I read something appropriate saying further vacant seats are filled simultaneously. I just looked though and I'm having trouble finding it.

What Supreme Court decision are you refering to?

Proportional Representation Act:

Did the Supreme Court really rule that this doesn't apply? I certainly don't think I was around when it did, if it did....

https://uselectionatlas.org/AFEWIKI/index.php/Decision_Text_-_2008_Atl._S.C.2d_7_%28Lewis_Trondheim_v._Department_of_Forum_Affairs%29

Found it. Very interesting. And an unfortunate decision.

Per my interpretation of this decision and regarding constitutional regulations concerning Class B vacancies, it would seem the only constitutional thing I could do would be to hold two individual, seperate IRV elections for two individual seats.

So much for proportionality.

Goes to show you how often multiple Class B seats need to be filled simultaneously. Apparently hasn't happened since I've been active in Atlasia, and that has been quite a while now...

Did PS and the boys change that section of the Constitution in the last convention?

Nope. I had hoped so, but it looks identical.

It will be beyond silly to hold seperate elections.  Do the right thing.

The case dealt with absentee booths, which isn't an issue right now.

But the court ruling explicitly ruled the part mandating that multiple seats be filled in one single election to be unconstutional.

It wasn't only about the absentee booth, even though the case was caused by it.

I'd really love to hold one single STV election....I really would, but does anyone see any way around such a clear statement by the Supreme Court?

Two thirds of the case is about absentee votes, however it's that section about the "Constitution speaking in singular and not plural" that is the problem.

It only gets worse when you know two of Supreme Court Justices from then are still on the Bench (I am guessing since Sam Spade joined it in July 2008, and the case references July 17th 2008, that he was already on the bench?).

So no chance for them reversing it.

I know that Bullmoose and Sam Spade voted in favor of this ruling. I don't think opebo said anything throughout the entire thing. No idea what he or Ebowed would think now.
